ACA Determined to be Unconstitutional by Texas Judge by AzHHA

Ann-Marie Alameddin, Vice President of Strategy and General Counsel

Last week a federal judge ruled that the entire Affordable Care Act (ACA) is unconstitutional because Congress repealed the tax penalty enforcing the law’s individual mandate.  However, the judge didn’t not immediately block the ACA from being enforced, instead leaving it the law of the land as the case winds its way through the courts.  The American Hospital Association has created a resource for hospitals that includes a summary and talking points for hospitals and health systems, click here to view the document.

McSally Takes Kyl’s Seat in the Senate by AzHHA

Less than four months of being appointed as state Senator, Jon Kyl announced that he will resign his Senate seat effective December 31st. This is not unexpected news as he had committed to serve until the end of the year upon his appointment in September. After months of speculation Governor Doug Ducey recently announced that Martha McSally, who narrowly lost the race for the state’s other U.S. Senate seat in November, would take the Senate seat along with Kyrsten Sinema. McSally and Sinema will serve alongside each other after facing off in one of the most contentious and expensive Senate races in Arizona’s history.

Resources Helping Opioid Prescribers Meet State Mandate by AzHHA

Shayna Diamond, Director of Community Affairs

Beginning January 1, 2019, the Arizona Opioid Epidemic Act mandates that any prescription for a Schedule II opioid to be transmitted electronically – the electronic prescribing of controlled substances (EPCS). This mandate would apply to prescribers in Arizona’s six largest counties. For prescribers in all other counties, there is a July 1, 2019 mandate. To increase EPCS in Arizona and prepare Arizona prescribers for this new state requirement, Health Current created the Click for Control campaign that includes a basic fact sheet, information and resources. If you have questions on EPCS or the Click for Control campaign, please contact Health Current at (602) 688-7200 or eRX@healthcurrent.org
