Implementation of Surprise Billing Requirements Underway / by Joe Furia

The Arizona Department of Insurance (ADOI) has issued a Notice of Proposed Rulemaking implementing the surprise out-of-network billing dispute resolution process as required under Laws 2017, Ch. 190, and amended by Laws 2018, Ch.  272. Comments on the proposed rule are due Sep. 30th.

In addition, ADOI is:

  • Drafting notices to be used in dispute resolution process
  • Procuring arbitrators
  • Developing an online system for consumers to request dispute resolution and for insurers and providers to provide information and documents pertaining to cases
  • Creating an employee position to administer the dispute resolution process

ADOI has also developed a website to assist consumers who may have received a surprise out-of-network bill. The site provides information on what constitutes a surprise out-of-network bill, how to try to avoid them, and how the dispute resolution process may be used to resolve them. ADOI welcomes any feedback on the new website, which can be sent here.
